Privacy policy

What we collect, why we hold it, how long we keep it, and what you can ask us to do with it.

Who we are

Shamba Space operates serviced farming sites in Kenya. In this policy "we" means Shamba Space, and "you" means anyone who contacts us or takes a plot with us.

We are the data controller for the personal data described here. That means we decide what is collected and why.

This policy is written to meet the Kenya Data Protection Act 2019.

What we collect

When you get in touch: your name, phone number, WhatsApp number, the area you are based in, how many plots you are interested in, what you want to grow, and anything you write in your message.

When you take a plot: the same details plus your identification for the agreement, your plot numbers, your term dates, your meter readings, your payments and any balance owed, and the services you ask us for.

We do not ask for an email address to make an enquiry, and we do not collect payment card details on this website.

How we collect it

Directly from you: through the form on this site, on WhatsApp, on the phone, or in person at a site.

The enquiry form on this site does not send anything to a server of ours. It opens WhatsApp with your answers written out, and nothing is sent until you press send there. Your message then sits in WhatsApp under WhatsApp's own terms.

Why we hold it

To answer your enquiry and arrange a visit. To prepare and run your plot agreement. To read your meter and bill you for water. To collect payment and manage any balance. To carry out work you ask us to do. To keep the records a business is required to keep.

We rely on your consent when you contact us, on the performance of our agreement with you once you take a plot, and on our legitimate interest in running the site and recovering what is owed.

Who we share it with

People who work for us at the site, so that they can allocate your plot, read your meter and carry out work you have asked for.

Our accountant, and our advocate if there is a dispute or an unpaid balance.

The landowner of a site where our agreement with them requires it, limited to what is necessary.

A public authority where the law requires us to hand something over.

We do not sell your personal data, and we do not pass your number to anyone for their own marketing.

Where it is kept

Records are kept in Kenya. Where a service we use stores data outside Kenya, we take reasonable steps to see that it is protected to a comparable standard, as the Act requires.

How long we keep it

Enquiries that do not lead to a plot: up to twelve months, then deleted.

Plot agreements, meter readings and payment records: for the length of your agreement and then for as long as tax and accounting law requires us to keep them.

We do not keep personal data for longer than we need it.

Keeping it safe

We limit who can see customer records to the people who need them, and we keep paper records secured at the site office. If a breach happens that is likely to harm you, we will tell you and the Data Commissioner as the Act requires.

Your rights

Under the Data Protection Act 2019 you can ask us for a copy of the personal data we hold about you, ask us to correct it if it is wrong, ask us to delete it where we no longer need it, object to how we are using it, ask us to restrict how we use it, and withdraw consent where consent is what we relied on.

If you are not satisfied you may complain to the Office of the Data Protection Commissioner in Kenya.

This website

This site does not use advertising cookies and does not track you across other sites.

The farm location page embeds a map from Google. If you load that page, Google may set cookies and receive your IP address under its own privacy policy. Nothing else on the site loads third-party trackers.

Links to WhatsApp open WhatsApp, which is operated by Meta under its own terms and privacy policy.

Changes

If we change this policy we will update the date at the top. Where a change materially affects you we will tell you directly.

This policy is a working draft and has not yet been reviewed by a Kenyan advocate or checked against your actual record-keeping. Confirm where records are held, who has access and which third parties are used before publishing it. Registration with the Office of the Data Protection Commissioner may also be required.
